对应当逮捕而本院侦查部门未移送审查逮捕的犯罪嫌疑人，侦查监督部门应当向侦查部门提出移送审查逮捕犯罪嫌疑人的建议。如果建议不被采纳，侦查监督部门可以报请检察长提交检察委员会决定。
