关于小型露天采石场安全距离问题的复函
安监总厅管一函〔2012〕200号
湖南省安全生产监督管理局：
你局《关于小型露天采石场安全距离如何适用有关法律法规的请示》（湘安监非煤〔2012〕59号）收悉。经研究，现函复如下：
一、小型露天采石场与其周边公路、铁路、电力设施之间的安全距离，应当执行《公路安全保护条例》（国务院令第593号）、《铁路运输安全保护条例》（国务院令第430号）、《电力设施保护条例》（国务院令第239号）等行政法规的有关规定。
二、小型露天采石场与其周边除公路、铁路、电力设施之外的其他生产生活设施之间的安全距离，法律、行政法规没有明确规定的，应当严格按照《小型露天采石场安全管理和监督检查规定》（国家安全监管总局令第39号）第三十一条的要求执行。
