湖南省安全生产监督管理局：
你局《关于尾矿库设计单位资质有关问题的请示》（湘安监非煤〔2012〕18号）收悉。经研究，现函复如下：
根据《尾矿库安全监督管理规定》（国家安全监管总局令第38号）的有关规定，具有冶金行业甲级和化工矿山甲级资质的设计单位可以从事其他行业三等以上（含三等）尾矿库建设项目安全设施设计工作。
