危险化学品建设项目有关问题的复函
安监总厅管三函〔2012〕100号
天津市安全生产监督管理局：
你局《关于危险化学品建设项目有关问题的请示》（津安监管〔2012〕15号）收悉。经研究，现函复如下：
一、《危险化学品建设项目安全监督管理办法》（国家安全监管总局令第45号）适用于危险化学品使用单位和经营单位用于储存危险化学品的建设项目的安全审查及其监督管理。
二、依据《危险化学品建设项目安全监督管理办法》的规定，危险化学品建设项目安全设施设计审查意见书没有规定有效期，但变更设计的，须重新审查。
三、对于违反《危险化学品建设项目安全监督管理办法》第四十一条、第四十二条规定的，安全生产监督管理部门应依法对建设单位予以处罚，并责令其限期整改。同时，应要求建设单位按照《危险化学品建设项目安全监督管理办法》的规定，提出未经审查或审查未通过的建设项目安全审查申请。
四、危险化学品生产企业在试生产期间能否销售其产品的问题，不属于安全生产监督管理部门的职能范围，应当由具有相应管理职能的工商部门负责。
