危险化学品单位安全监管有关问题的复函
安监总厅管三函〔2012〕97号
广东省安全生产监督管理局：
你局《关于使用危险化学品单位涉嫌违法违规行政处罚有关问题的请示》（粤安监〔2012〕73号）收悉。经研究，现函复如下：
一、关于使用危险化学品的单位和作业场所的界定
根据《危险化学品安全管理条例》（国务院令第591号，以下简称《条例》）规定，使用危险化学品的单位，是指使用纳入《危险化学品名录》（2002年版）中的危险化学品的单位。其作业场所的界定，按照《危险化学品生产企业安全生产许可证实施办法》（国家安全监管总局令第41号）第五十四条第三款的规定执行。
二、关于使用危险化学品的单位违法行为的处罚
根据《条例》规定，使用危险化学品的单位应当遵循有关生产、储存危险化学品的规定，因此，对于违反《条例》第八十条规定情形的使用危险化学品的单位，安全生产监督管理部门应当依法给予处罚。
三、关于使用危险化学品的单位设置安全设施、设备有关适用标准
使用危险化学品的单位在作业场所设置相应监测、监控、防静电等安全设施、设备时，应当执行《建筑设计防火规范》（GB 50016）、《石油化工企业设计防火规范》（GB 50160）、《石油化工可燃气体和有毒气体检测报警设计规范》（GB 50493）等有关标准。
